Terms and Conditions
1. Ownership and Control
The website sure.financial ("Website") and the mobile application titled "Sure" ("Application") is owned, operated, managed and controlled by Vittancial Technovations Private Limited ("Sure"), company incorporated under the laws of India with its registered office at MG LINK RD,BHANDUP, Mumbai Maharashtra – 400078 India, under the brand name "Sure".
2. Acceptance of Terms
Sure offers the Website, the Application and any Services conditioned upon the User's acceptance of all terms conditions policies and notices stated here. By procuring a Service from Sure, or by use of the Website or Application, the User hereby agrees to be bound by these terms and conditions ("Terms of Service"), as applicable, to the use of the Website, the Application and any Services.
3. Services
Sure facilitates the Users to evaluate their credit profile and may provide facilities that may include online utility payments through the Website and/or the Application ("Services"), and shall include any other services provided by Sure from time to time.
4. User Responsibilities
Users agree to take full responsibility for the transactions made on the platform with respect to the nature of transaction and the tax implications pertaining to the same. Sure and its payment partners act as mere facilitators of authorized payments and shall not assume responsibility nor liability for any unauthorized transactions.
5. Compliance with Laws
The User is solely and exclusively responsible for understanding and complying with all applicable laws of the User's specific jurisdiction, including but not limited to the RBI Guidelines on Regulation of Payment Aggregators and Payment Gateways, Payment and Settlement Systems Act, 2007, Prevention of Money Laundering Act, 2002, Income Tax Act, 1961, Know Your Customer (KYC) / Anti-Money Laundering (AML) / Combating Financing of Terrorism (CFT) guidelines issued by the Department of Regulation, RBI (the"KYC GUIDELINES") etc., that may be applicable to the User in connection with the business and use of Sure.
6. Eligibility
By agreeing to these Terms of Service, a User (which such User is a natural Person) represents that the User is at least the age of majority i.e. 18 years, and is competent to contract. Additionally, where the User is registering on behalf of, and is the authorized representative of, a company, partnership or any other legal entity, such User has been duly authorized by such entity and is permitted under Applicable Laws to accept these Terms of Service.
7. Registration
In order to avail the Services, User must be registered with Sure and the Service Providers, if required. The User shall provide Sure with all such documents as may be required by Sure for identity verification of the User.
8. Security
The User will not hold Sure liable in case of any improper/ fraudulent/unauthorized/ duplicate/erroneous use of his/her mobile and/or the web-based access or through any other platform due to loss or theft of his mobile or cloning of his/her mobile or for any other reason whatsoever.
9. Intellectual Property Rights
The Application content and the trademarks, service marks and logos contained therein ("Marks") are owned by or licensed to Sure, subject to copyright and other intellectual property rights under the law and international conventions.
10. Disclaimer of Warranties
All content and functionality on the application is provided "as is", without warranty of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
11. Limitation of Liability
User expressly acknowledges and agrees that, to the maximum extent permitted by law, the entire risk arising out of his access to and use of the application and services, remains with him.
12. Indemnity
User shall keep Sure and its Service Providers safe and harmless and indemnified from and against any and all liability (including but not limited to liabilities, judgments, damages, losses, claims, costs and expenses,) or any other loss that may occur, arising from or relating to any claim, suit or proceeding brought against Sure by another User/ Service Provider/ third party for reasons including, but not limited to delivery, non-delivery or delay, deficiency or mistake in respect of the products purchased sold or services rendered.
13. Termination
If either Sure or Service Provider suspects, on reasonable grounds, that a User has committed a breach of these Terms or any other agreement with Sure or any act of dishonesty or fraud against Sure/ any Service Provider, Sure shall be entitled to (a) deactivate/ suspend the User Account and disable the User's Password and (b) terminate User's access to the Application or the Services; pending enquiries by Sure.
14. Jurisdiction
All claims, matters and disputes are subject to the sole and exclusive jurisdiction of the competent courts in Mumbai, State of Maharashtra.
15. Loans
You while applying for product/services on our website authorize us, our affiliates & our associate partners to give you a call/sms/e-mail for the related product and services, imparting product knowledge, offer promotional offers & offers offered by the associated third parties even if you have registered yourself under DND or DNC or NCPR services till 180 days of your registration with us.
By accepting our "Terms and Conditions" and "Privacy Policy" you authorize our partners to run a credit/bureau check for your profile.
16. Bill Payments
The following terms and conditions (“Sure Bill Payment T&Cs”) are specific to the use of the bill payment product introduced by Sure which allows users to pay bills from various billers (or make pre-paid mobile recharge payments) including but not limited to electricity distribution companies, piped gas distribution companies, broadband companies, telecom companies, insurance companies (“Sure Bill Payment”). All Users accessing the Sure Bill Payment screen or using Sure Bill Payment shall be deemed to have read, understood and agreed to be bound by these Sure Bill Payment T&Cs.
16.1. Eligibility
Sure shall make Sure Bill Payment available to some or all of Sure Users at its sole discretion. Sure may also suspend or discontinue offering Sure Bill Payment for any Sure Users at its sole discretion.
16.2. Information access, biller data and disclaimers
By using Sure Bill Payment, you authorize Sure to access emails and SMS messages related to your billers, bill reminders, and payment confirmations if you have granted the necessary permissions to the Sure App. Without these permissions, Sure Bill Payment may be limited. Sure may periodically retrieve bill details and payment statuses from billers or via the BBPS system, displaying this information on the Sure App and sending reminders about outstanding dues. To stop receiving updates for a particular biller, you can archive that biller on the Sure App. You may also add a new biller by entering the necessary details. Sure endeavours to ensure accuracy in the information displayed, which is drawn from various sources such as emails, SMS, and billers, but cannot guarantee error-free data. We recommend verifying your bill details before making a payment. Sure may also use your bureau data to retrieve bill details and payment statuses, in compliance with RBI guidelines
16.3. Payment Processing
Sure enables you to pay your bills or make additional payments to billers using select payment methods. These payment options may be updated at Sure’s discretion based on success rates or other factors. Sure does not guarantee the continued availability of any specific payment method. Payments to billers will only be processed once Sure has received funds from your payment method (e.16., credit card). Sure is not liable for delays due to actions or issues from banks or payment gateways involved in your transaction. You agree to hold Sure harmless for any disputes arising between you and the biller, payment gateway, or your bank. Bill payments cannot be reversed once initiated. While Sure strives to process payments promptly, it may delay, suspend, or reject transactions if they appear to pose financial or security risks, or if they are unauthorized, fraudulent, or otherwise in violation of the law, these Terms, or Sure’s policies. Sure may charge a service fee for transactions, which will be displayed on the transaction screen before payment is initiated. Sure is not liable for bill payment delays caused by the biller. To avoid late fees, we recommend you pay bills early
16.4. Indemnification
You agree to not hold Sure responsible and/or liable for any issue or claim arising out for any dispute whatsoever between You and the payment gateway or Your bank or the Counterparty (including but not limited to billers and the BBPS system). You shall keep Sure indemnified and hold Sure harmless in the case of any third-party claims against Sure (whether by the Counterparty, payment gateway, bank, any government authority or any other Person) for the payments made or attempted to be made by You (or any other Person through your account) using Sure Bill Payment.
16.5. Information Input
You are responsible for all the information you input during your use of the Sure App including the Sure Bill Payment features. You are responsible for ensuring that all the payment details provided by you are accurate. In particular you are responsible for ensuring the correctness of (i) details of the biller / bill account number; (ii) details of the payment instrument (or selection from the saved payment instrument); and (iii) the amounts of payment. In the event you input any of these details incorrectly or as suggested by Sure, You will be responsible for the resultant transaction and all charges that result from the same. Sure may at its own discretion, without having any obligation to do so, assist in reversing such transactions if technically feasible and viable for Sure. Sure may ask for additional information if required from time to time including but not limited bill copies etc to verify the underlying transactions, and in case you fail to provide such information then you may be unable to use the Sure Bill Payment features offered by Sure. Further, Sure may ask for additional documents in case a transaction appears to be suspicious. Failure to provide such documentation within 72 hours may result in your transaction failing and at Sure's sole discretion, Your access to Sure Bill Payments being revoked.
16.6. Disclaimers
Sure Bill Payments feature is provided by Sure through a) aggregators with whom Sure has a contract or b) through the Bharat Bill Payment Operating Unit (BBPOU) infrastructure where the Biller is registered with NPCI for bill payments. Accordingly, Sure Bill Payments may be unavailable or settlement delayed in the event of any downtime or issues attributable to Sure's partners. Once a payment has been initiated it cannot be reversed and Sure will not be liable in any way for any loss You suffer as a result of a transaction being carried out in accordance with the instructions issued by You. Sure shall process the payment only after Sure has received (i) the payment from your credit card or other relevant payment instrument; and (ii) any further information requested from You by Sure. Sure shall not be responsible for any delay occasioned due to any action or inaction on account of any bank or payment gateway or the counterparty: the biller, the BBPS payment system involved in your transaction. Sure does not guarantee any timelines for payments to the Counterparties. Any timelines mentioned on the Sure App or other Sure Platforms are merely indicative in nature and not to be construed as guarantees. While Sure undertakes its best efforts to process the payment as directed by you at the earliest, Sure may delay, suspend, or reject a transaction for any payment(s) for any reason, including without limitation if we suspect the transaction poses a financial or security risk, or is unauthorized, or is fraudulent, suspicious, unlawful or in any way in violation of the applicable laws around such transactions or in violation of these Sure Bill Payments T&Cs, subject to dispute or otherwise unusual. Sure recommends You to pay your bills with sufficient gap from the due date and You agree to not hold Sure liable in case of delay of payment of your bill
16.7. Offers
Sure may from time to time make available either directly or in partnership with its Commercial Partners, certain benefits for using Sure Bill Payment. All such offers shall be governed by their terms and conditions as displayed on the Sure App in addition to these Sure Bill Payment T&Cs. Sure's decision of the winner of such offers shall be final and binding and not subject to any appeal or dispute resolution process.
17. Refunds
Sure is not responsible for payments sent to an incorrect credit card or account input by you. If your payment instrument is charged but not credited to your account within 72 hours, please contact Sure’s customer support through the app. We will investigate, and if a payment error is verified, a refund will be issued within 21 working days (or per applicable law). Refunds will be sent to the original payment method or a Specified Refund Account, verified by you. Sure reserves the right to determine the refund method in line with legal requirements. Sure disclaims liability for any refund errors due to bank, card network, or intermediary service provider issues. If a payment is wrongly credited to your account, Sure reserves the right to initiate a refund via your bank. You consent to this correction and will be informed once the transaction is processed
